Fax Me Outside — Terms of Service

Terms of Service

Effective: [launch date]

These terms cover your use of Fax Me Outside (faxmeoutside.com). By uploading a document and sending a fax through the service, you agree to them. They are written in plain language on purpose — if anything is unclear, contact us before you send.

1. Personal use only

Fax Me Outside is built for individuals sending their own documents — a lease, a form for the DMV, paperwork for a court or an insurer. It is not intended for organizational, institutional, or commercial fax operations, and we don't offer service agreements, volume contracts, or integrations built around business use.

2. No health information, no exceptions

Fax Me Outside does not offer a Business Associate Agreement, and the service must not be used by a covered entity or business associate (as those terms are defined under HIPAA) to transmit protected health information. Do not use this service to send medical records, insurance claims containing health details, or any other protected health information. If you are unsure whether your document qualifies, do not send it here.

3. No advertising or bulk faxing

This service is not for advertising, marketing, solicitation, or bulk or unsolicited faxing of any kind. You are solely responsible for making sure any fax you send complies with the Telephone Consumer Protection Act (TCPA) and all applicable junk fax laws. We may refuse service or suspend access if we believe a submission violates this section.

4. Your responsibility for content and recipients

You are responsible for the accuracy of the destination fax number and for the legality and accuracy of everything you transmit. We send what you upload to the number you provide — we don't review document contents before sending.

6. Refunds

Your card is authorized, not charged, when you check out. We only capture the charge once the fax is confirmed delivered. If a fax fails after all retries, the authorization is automatically cancelled — you are never charged for an undelivered fax. Depending on your bank, a released authorization can take 5 to 10 business days to disappear from your statement or account balance.

7. Rate limits and refusal of service

We may apply rate limits per destination number and per sender to prevent abuse, and we may refuse or cancel service at our discretion, including where we suspect fraud, abuse, or a violation of these terms.

8. No warranties

The service is provided as is, without warranties of any kind beyond the refund policy described in Section 6. We do not guarantee that a fax will be delivered on any particular timeline, and delivery depends on factors outside our control, including the condition of the recipient's fax line.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising from your use of the service is limited to the amount you paid for the fax in question. We are not liable for indirect, incidental, or consequential damages.

10. Governing law

These terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
